Terms of Service

By creating an account, installing the extension, or using any part of our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

• You must be at least 13 years old to use Violingo
• If you are under 18, you must have parental or guardian consent
• You must have the legal capacity to enter into these Terms
• You must not be prohibited from using the Service under applicable law

To use certain features, you must create an account with accurate information:

• Provide a valid email address
• Create a secure password
• Maintain the security and confidentiality of your account credentials
• Notify us immediately of any unauthorized access to your account
• You are responsible for all activities that occur under your account

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• Install and use the Violingo Chrome extension on devices you own or control
• Access and use the Service for personal, non-commercial language learning purposes
• Access your learning data through your account

You agree NOT to:

• Reverse engineer, decompile, disassemble, or attempt to derive source code from the extension
• Modify, adapt, translate, or create derivative works of the Service
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use the Service for any illegal or unauthorized purpose
• Circumvent any access restrictions, rate limits, or security features
• Use automated scripts, bots, or scrapers to access the Service
• Resell, rent, lease, or sublicense access to the Service
• Share your account credentials with others
• Create multiple accounts to circumvent service limitations
• Use the Service to violate Netflix or YouTube's Terms of Service
• Extract, copy, or redistribute subtitle content for commercial purposes
• Attempt to gain unauthorized access to our systems or other users' accounts
• Upload or transmit malicious code, viruses, or harmful content
• Interfere with or disrupt the Service or servers

Important Disclaimer: Violingo integrates with Netflix and YouTube to provide language learning features. However:

• Violingo is NOT affiliated with, endorsed by, or sponsored by Netflix or Google/YouTube
• You must maintain valid, active subscriptions to Netflix and/or YouTube to use those features
• You are solely responsible for complying with Netflix and YouTube's Terms of Service
• We do not host, store, or provide access to Netflix or YouTube video content
• Availability of features may depend on third-party platform changes beyond our control

Regarding subtitle text extracted through Violingo:

• Subtitle text is for personal educational use only
• You may not redistribute, publish, or commercially exploit subtitle content
• You must respect copyright and intellectual property rights of content providers
• We respect DRM and content protection measures
• You agree not to circumvent any copy protection or access controls

Our Service uses these third-party providers:

• Supabase: For authentication and database services
• Stripe: For payment processing (subject to Stripe's terms)
• OpenAI: For optional AI-powered features (if enabled)

Each provider operates under their own terms and privacy policies. We are not responsible for third-party services' availability, security, or practices.

Violingo offers the following subscription tiers:

• Basic Plan: $9.97/month - 100 credits/month
• Premium Plan: $24.97/month - 300 credits/month
• Pro Plan: $69.97/month - 1,000 credits/month

Prices are in USD and exclusive of applicable taxes. We reserve the right to change pricing with 30 days' advance notice.

• Subscriptions automatically renew on your billing date each month
• You authorize recurring charges to your payment method
• Failed payments may result in service suspension
• Credits are granted at the start of each billing period
• Unused credits do NOT roll over to the next billing period
• We are not responsible for payment processing errors by Stripe

• You may cancel your subscription anytime through account settings
• Cancellation takes effect at the end of your current billing period
• You retain access to paid features until the end of the billing period
• No refunds are provided for partial billing periods
• Unused credits are forfeited upon cancellation

• Refund requests must be submitted within 7 days of the charge
• Refunds are granted at our sole discretion
• No refunds for unused credits or partial months
• Abuse of refund policy may result in account termination
• To request a refund, contact support@violingo.ai

• New users may receive free trial credits
• Free trial terms are specified at signup
• We may modify or discontinue free trial offers anytime
• One free trial per user

The Service, including the Chrome extension, website, features, and all related content (excluding User Content and Third-Party Content) are owned by Violingo and protected by:

• Copyright laws
• Trademark laws
• Patent laws
• Trade secret laws
• Other intellectual property rights

All rights not expressly granted are reserved by Violingo.

You retain ownership of content you create through the Service (vocabulary lists, notes, study progress). However, you grant us:

• A worldwide, non-exclusive license to store and process your content
• The right to use your content solely to provide and improve the Service
• The right to create backups and copies for service continuity

We will not share your personal learning data with third parties except as described in our Privacy Policy.

If you provide suggestions, ideas, or feedback about the Service:

• We may use your feedback without compensation or attribution
• You grant us a perpetual, irrevocable license to implement your suggestions
• Feedback does not create any confidential relationship

You agree to:

• Provide accurate, current, and complete account information
• Maintain the security of your password and account
• Notify us immediately of unauthorized access or security breaches
• Use the Service in compliance with all applicable laws and regulations
• Respect the intellectual property rights of others
• Not use the Service for illegal, fraudulent, or harmful purposes

• You are responsible for all activity under your account
• Do not share your account credentials
• Use a strong, unique password
• Enable two-factor authentication if available
• Log out from shared or public devices

When providing platform access (Netflix/YouTube):

• You must have legal authorization to access the content
• You must comply with content provider terms and restrictions
• You must not attempt to bypass geographic restrictions or DRM

To the fullest extent permitted by law, we disclaim all warranties, including:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding accuracy, reliability, or completeness of content
• Warranties regarding third-party services or integrations

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are NOT liable for indirect, incidental, special, consequential, or punitive damages
• Our total liability is limited to the amount you paid in the last 12 months (minimum $100)
• We are not responsible for loss of data, profits, or business opportunities
• We are not liable for damages caused by third-party services
• We are not responsible for network outages or service interruptions

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

We do not guarantee:

• Continuous, uninterrupted access to the Service
• Compatibility with all devices or browsers
• That the Service will meet your specific requirements
• Error-free or secure operation
• That defects will be corrected promptly

You may terminate your account at any time by:

• Canceling your subscription through account settings
• Contacting support@violingo.ai to request account deletion
• Uninstalling the extension

We may suspend or terminate your account immediately if:

• You violate these Terms
• You engage in fraudulent activity
• You abuse the Service or harass other users
• Payment fails repeatedly
• We suspect unauthorized account access
• Required by law or regulatory authority
• We discontinue the Service

Upon termination:

• Your right to use the Service immediately ceases
• You lose access to your account and data
• We may delete your data per our data retention policy
• No refunds are provided for remaining subscription time
• You may request data export within 30 days
• Sections of these Terms that should survive termination will remain in effect

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service
• Change features, functionality, or availability
• Update subscription pricing with 30 days' notice
• Add or remove integrations with third-party services

We will make reasonable efforts to notify users of significant changes.

We may update these Terms from time to time:

• Updates will be posted with a new "Last Updated" date
• Material changes will be communicated via email or in-app notice
• Continued use after changes constitutes acceptance
• If you disagree with changes, discontinue use and close your account

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

Before filing any legal claim, you agree to first contact us at legal@violingo.ai to attempt informal resolution. We will work in good faith to resolve disputes.

Any disputes not resolved informally will be settled by binding arbitration rather than in court, except:

• Small claims court actions
• Intellectual property disputes
• Injunctive relief requests

Arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitrator's decision is final and binding.

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS-WIDE ARBITRATION.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Violingo regarding the Service.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

You may not assign or transfer these Terms or your account. We may assign our rights and obligations without restriction.

We are not liable for delays or failures due to events beyond our reasonable control, including natural disasters, war, terrorism, riots, pandemics, or government actions.

You agree to comply with all export and import laws. You may not use the Service if you are located in a country embargoed by the United States or listed as a prohibited party.
